Your contracting party for Padelcademy Pro is Daniel Woller, sole trader, Stöckachstr. 60, 97249 Eisingen, Germany, email kontakt@padelcademy.com. These terms apply to purchasing Pro on the web; the terms of use apply in addition. In the event of a conflict, these Pro terms prevail. Purchases in the iOS or Android apps are currently not possible.
Pro is a digital service: for the duration of your access, Pro unlocks the following for your Padelcademy account:
Pro applies to one account, on the web and in the apps, and cannot be transferred to another account. What remains free without Pro — including recording and storing your matches, manual entry of fitness values, Padel IQ, daily challenge, rules and content marked as free — remains free. Features that do not exist yet (for example importing values from Apple Health or Health Connect) are not part of Pro as long as they are not available.
During the term we provide the updates required to keep the service in conformity with the contract. We only make changes going beyond what is required for a valid reason and announce them in advance; if they impair your access more than insignificantly, you can end the contract free of charge (§ 327r German Civil Code, BGB).
Prices are final prices. We only sell Pro if the German small business VAT exemption applies to your purchase; this depends on your country (section 4). In that case the order summary and the contract confirmation state: “Gemäß § 19 UStG wird keine Umsatzsteuer berechnet (Steuerbefreiung für Kleinunternehmer)” — under § 19 of the German VAT Act no VAT is charged (small business exemption). With a partner code, the price may be reduced under the code terms; the reduced price, how long it applies and the price afterwards are shown in the order summary before purchase.
Who can buy. We sell Pro to consumers resident in Germany or another member state of the European Union. In the ordering process you choose your country of residence; nothing is preselected. After payment, our server checks whether the country of your billing address is in the EU and matches your country of residence and whether the country of your payment method (issuing country of the card or country of the account), where Stripe tells us, is in the EU. If not, we do not unlock Pro, no contract is concluded and we refund the payment in full. For individual EU states, sales may temporarily not be enabled, for example for tax reasons; you see this before you pay. Free use of Padelcademy does not depend on any of this.
Process. You need a Padelcademy account to buy. In the app you choose the offer and your country of residence, enter a partner code if you have one and go to the order summary. There you enter your payment details and billing address in the embedded payment field of our payment service provider Stripe and, directly above the order button, see product, total price, term, renewal or end, start of the service, information on the right of withdrawal and any code discount. Until you click "Order with obligation to pay" you can check and change your details or cancel the process.
By clicking "Order with obligation to pay" you make a binding offer. Stripe then executes the payment; if your bank requires an additional confirmation (for example 3-D Secure), you only confirm the payment there — you do not place a further order. The contract is concluded as soon as the payment is confirmed on our server and we unlock Pro for your account. If the result of a payment is only known later (for example with a direct debit), the app shows "Payment processing" until then. If the first payment fails, no contract is concluded and Pro is not unlocked.
After the contract is concluded you receive a contract confirmation by email with these terms, the withdrawal information and the model withdrawal form. Our contract emails are sent from "Padelcademy <noreply@auth.padelcademy.com>"; replies reach us at kontakt@padelcademy.com. We store the contract text; you can access these terms on this page at any time.
Pro starts as soon as the payment is confirmed; if you buy the 12-month access during a monthly subscription, it starts at the end of the month already paid for (section 6). As a consumer you have a 14-day right of withdrawal; details are in the withdrawal information.
Because Pro starts immediately, you use a box in the order summary that is not pre-ticked to expressly request that Pro starts before the withdrawal period has expired. Without this tick Pro currently cannot be ordered. Your right of withdrawal still applies for the full 14 days.
What you get back if you withdraw. As a rule we refund the full amount. We only keep a proportionate amount for the time until withdrawal (compensation for value) if all conditions for it are met: you expressly requested that Pro starts before the withdrawal period expires, we properly informed you beforehand about your right of withdrawal and the compensation for value (§ 357a(2) BGB), and we provided you with the contract confirmation by email. The compensation is then: amount paid × days used ÷ days of the period paid for; a started day counts as used, and the amount is rounded down to the full cent. If the service has not started yet (for example a 12-month access that only starts after your current month), no compensation is due. We refund the rest. Your statutory claims take precedence over this calculation. We store the time of your declaration and the text version you agreed to.
Monthly subscription: You can cancel at any time with effect from the end of the current billing month. Pro remains active until the end of the paid month; no further payment is taken afterwards.
12-month access: It ends automatically after 12 months; no cancellation is needed.
Switching from the monthly subscription to the 12-month access: During a running monthly subscription — even one already cancelled — you can buy the 12-month access. Switching is not possible while the seven days after a failed renewal payment are running (see “Failed renewal”). You pay for it immediately; it starts at the end of the month already paid for, so no paid time is lost and nothing overlaps. The monthly subscription then ends at that time without any further charge. After a 12-month access has ended you can take out a monthly subscription. Otherwise you cannot buy a further paid access alongside a running one. How a partner-code discount continues after a switch is set out in the code terms.
The right to terminate for good cause remains unaffected for both offers.
Your data is kept. When Pro ends, we do not delete any stored data, results, progress or drafts. Pro content and Pro features are no longer accessible afterwards; you can continue to view what you have saved under the free rules. The first free training session, once adopted, remains usable with its drills.
You can cancel the monthly subscription without giving reasons via the button "Cancel contracts here". Via the same button you can also cancel the 12-month access for good cause (extraordinary cancellation); you then state the reason and we review the cancellation. It is in the app's menu and footer and can be reached directly at padelcademy.com/app.html?kuendigen=1, permanently and also without signing in. On the following confirmation page you state which contract you want to cancel and how we can reach you, and confirm with "Cancel now". You immediately receive a confirmation by email with the date and time of the cancellation and, where already determined, the time at which the contract ends. You can also cancel by email to kontakt@padelcademy.com.
You can withdraw within the withdrawal period via the button "Withdraw from contract" (in the app's menu and footer, directly at padelcademy.com/app.html?widerrufen=1, confirmed with "Confirm withdrawal") or with any other clear statement, for example by email; you also receive an acknowledgement of receipt by email for this.
Payment is processed by the payment service provider Stripe. Which payment methods you can use depends on the offer: for the monthly subscription only payment methods that allow recurring charges are available, for the 12-month access those enabled for one-off payments. You see which ones at the start of the ordering process for each offer; the selection shown in the order summary for your purchase is decisive. Wallet payment methods (for example from Apple or Google) only appear if they are enabled and your device or browser supports them. We do not receive full payment details from Stripe.
Invoice. For each payment you receive an invoice by email, after the payment, at the email address of your Padelcademy account. We create it with our payment service provider Stripe, which sends it on our behalf; it includes the note on the German small business VAT exemption (§ 19 UStG). The contract confirmation is not an invoice.
Failed renewal. If a renewal payment for the monthly subscription fails, Pro remains active for seven more days from the end of the paid month; the app shows you until when. During this time Stripe retries the payment. If it succeeds, the subscription continues as normal. If it does not, your Pro access ends after the seven days and the subscription is terminated. We then do not claim payment for the seven days or for the unpaid month; if a payment for that month arrives later after all, we refund it in full without reopening the access. Your data is kept.
If we refund a payment in full, the corresponding Pro access ends. If a payment is charged back (for example via your bank), we suspend the affected Pro access until the matter is clarified; if it is resolved in our favour, the access applies again, otherwise it ends. Your data is kept in any case. If you withdraw from the contract, a monthly subscription ends immediately and a 12-month access ends with the withdrawal; the refund follows the withdrawal information and section 5. Your statutory rights, in particular the right of withdrawal and the rights in case of defects of digital products (§§ 327 ff. BGB), remain unaffected.
You can delete your account yourself at any time. If a paid Pro access is running, the app clearly points this out before you confirm: with the deletion your Pro access ends immediately. We end a monthly subscription before the deletion so that no further charge is made afterwards; a 12-month access ends with the deletion. For the remaining term there is no proportionate refund when you voluntarily delete your account, including for the 12-month access.
Your statutory rights remain unaffected, in particular withdrawal within the withdrawal period (section 5 then applies) and your rights in case of defects. You can also assert them after the deletion by email to kontakt@padelcademy.com. So that we can still handle them, your email address remains stored with the order for two years after the deletion and is then deleted automatically. Order and payment details that we must keep under commercial and tax law remain stored without a link to an account for the statutory period (see privacy policy).
Discount codes from partners and friend codes are subject to the code terms.
We are liable without limitation for intent and gross negligence, for damage resulting from injury to life, body or health, under the German Product Liability Act and to the extent of any guarantee given. Otherwise, liability is governed by the statutory provisions.
Changes to these terms only take effect for a running monthly subscription if you agree to them. For 12-month access already purchased, the terms in force at the time of purchase apply.
German law applies. If you are a consumer habitually resident in another country, the mandatory consumer protection provisions of that country remain unaffected. We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board. The German version of these terms is authoritative.
